CITY OF MAYFLOWER, ARKANSAS
COMMUNITY CENTER RENTAL LIABILITY RELEASE AND WAIVER AGREEMENT
This Liability Release and Waiver Agreement (“Agreement”) is made by and between the applicant (“Renter”) and the City of Mayflower, Arkansas (“City”), collectively referred to as the “Parties,” for the rental and use of the Mayflower Community Center located at 3 Ashmore Drive, Mayflower, AR 72106.
- Assumption of Risk:
The Renter acknowledges and understands that the use of the Community Center for private functions may involve certain inherent risks, including but not limited to personal injury, property damage, or other hazards. The Renter voluntarily assumes all risks associated with the use of the premises.
- Release and Waiver:
In consideration for being permitted to use the Community Center, the Renter agrees to release, waive, discharge, and hold harmless the City of Mayflower, its elected officials, employees, agents, and volunteers from any and all claims, liabilities, demands, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by the Renter or any guest or participant, whether caused by negligence or otherwise, during the use of the facility.
- Indemnification:
The Renter agrees to indemnify, defend, and hold harmless the City and its representatives from and against any and all losses, claims, damages, liabilities, expenses, or costs (including attorney’s fees) resulting from the Renter’s use of the Community Center.
- Facility Rules and Responsibilities:
- The Renter agrees to follow all Community Center rules, regulations, and city ordinances.
- The Renter is responsible for the conduct of all guests.
- The Renter is liable for any damages to the facility during the rental period.
- No illegal substances or activities are permitted on the premises.
- The facility must be returned in a clean and orderly condition.
- Insurance:
The City reserves the right to require the Renter to provide a Certificate of Liability Insurance naming the City of Mayflower as an additional insured.
- Severability:
If any provision of this Agreement is held invalid or unenforceable, the remainder shall continue in full force and effect.
- Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of the State of Arkansas, and the Renter is advised that the City of Mayflower is statutorily immune from liability and from suit for damages except to the extent that it may be covered by liability insurance.
